Temporary Agricultural Worker Program
The H-2A temporary agricultural program allows agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers to the U.S. to perform agricultural labor or services of a temporary or seasonal nature.
Employment of a seasonal nature is tied to a certain time of year by an event or pattern, such as a short annual growing cycle, and requires labor levels above what is necessary for ongoing operations. Employment is of a temporary nature when the employer's need to fill the position with a temporary worker will, except in extraordinary circumstances, last no longer than one year.

The H-2A application begins with a Job Order posted on your State Workforce Agency (SWA). Once approved, the next application is submitted to Dept. of Labor for their review. Next is the recruitment period to afford U.S. workers first opportunity to apply for positions, followed by a Certification. Final steps include USCIS final approval, processing of foreign workers at U.S. embassy’s and travel to begin work.

The H-2A wage is issued by Dept. of Labor and is called the AEWR (Adverse Effect Wage Range). This wage may change at any time during the year.

H-2A employer requirements is providing optional employee housing at no cost to the employee, another is employer provides daily transportation from housing to worksite and return each workday. During our first meeting, we will discuss the other employer responsibilities for the H-2A Program.
